I got unpaid rent recovery after 4 years of struggle, patience, anxiety. I want to share my experience for the benefits of those Landlords who are trying to recover unpaid rent dues from their ex-tenants. This is my timeline
1: Got tenants eviction through LTB in March 2022 with unpaid rent of $20K
2: Although i knew where my ex-tenant was working but i had no knowledge of his new address therefore i didn’t initiate garnishment process for at least 2 years.
3: Then through a skip tracer using tenants driving license info, i was able to find his current address. Therefore, got the garnishment order through Small claim court andserved in person to both tenant and his employer through a process server.
4: Both parties didn’t respond to the garnishment order and his employer failed to file a garnishee’ statement within 10 days of being served with notice of garnishment.
5: Then i applied for the Garnishment hearing and both parties didn’t show up in the court on the hearing day. Therefore, court Judge gave an order against tenant’s employer (Garnishee) making him to be liable of full garnishment amount.
6: Then i initiated Examination hearing against the employer. Just one week before the scheduled examination hearing date, employer’s lawyer sent me the full garnishment amountand thus this long enforcement process ended in a successful recovery.
