SOLO Landlord Story #11: Caught 3 times in Covid Shutdowns and the system allowed me to lose 40K.

As of June 8, 2021 a Professional Tenant was still in my house. The Sheriff finally enforced the eviction on June 14, 2021.

I rented out my ONLY semi detached house with a fully finished basement in Mississauga to a lady with her two roommates back in October 2017, through a realtor and utilized his services as a property manager, as I was moving across the border due to a job loss. I mentioned in the lease agreement that she is not allowed to sublet my house or portion of my house to anybody. Shortly after, my neighbor told me that  she has accommodated 4/5 other people in my house. That means she was making at least double the money, she was paying me for rent.   Then starting March 2020 she stopped paying the rent.  I filed an N4 in April 2020. I got a hearing in Dec 2020, wherein the tenant demanded to write off the full unpaid rent, which I refused. The timeline of my case is given below.

March 2020 – Tenant stopped paying rent & water bill.

April 2020- Filed eviction application (L1) at LTB. 

Dec 2020 – CMH & merit hearing.

Jan 13, 2021 – Eviction order issued 

Jan 13, 2021: 2nd Stay home order/ Eviction ban was enforced.

Jan 25, 2021: Filed Eviction order at Sheriff office.

March 8, 2021- Eviction ban lifted in the Peel; Eviction scheduled for April 8.

April 7: 3rd Stay home order/ Eviction ban was enforced. 

Today, June 8, 2021 – Still waiting for the implementation of the Eviction order and she is enjoying free housing.

My tenant had a job when she moved into my property and she provided her company letter with her application. After about a year I was told that she is on disability now.  When she stopped paying the rent, I wrote to her that you are receiving your ODSP benefits, why are you not paying me the rent? She replied that “You insulted me saying that I am on ODSP, for your info I am not on any Government Support. All her roommates worked during Covid, so no excuse for not having money to pay. I had asked my property manager to keep sending photos of the driveway.  One photo shows a notice on the front door “Don’t ring the bell, residents work in shifts”. I provided this photo to the LTB before my hearing.  On Nov 11, the moment she received LTB hearing email, she intentionally damaged the dishwasher inlet valve to flood the basement ceiling. Then she sent me dozens of emails regarding the  ceiling, asking me to repair it ASAP. My PM arranged for a plumber telling her that he will be there the next day at 8am, but the b***h pretended that she was not at home so did not allow the plumber to get in for two days. I sent all these photos to LTB with cc to my MPP, PM, housing minister, AG & Ombudsman, requesting an urgent hearing / emergency eviction, but no response was received. 

During the case management hearing she asked me to write off the unpaid rent ($25K, then), only then she will try to pay the rent in future. Of course, I did not accept it. She did not show up at the merit hearing. She received the eviction order on Jan 13, 2021 when the 2nd stay home order was enforced. She peacefully continued living free till the eviction ban was lifted on March 8, then she appealed LTB to reschedule the case hearing as she could not receive merit hearing notice because her email account got locked during those days. But LTB rejected her appeal. 

She is the greediest creature I came across till now. She is doing fundraising for the treatment of her dog and for her moving expenses, and telling  people that my landlord is moving in so she has to move to a new place. She has collected approximately $6000 in donations so far. All her remaining roommates  may not know that she is being evicted for non-payment of 16 months’ rent. My property manager did not want to disclose her non-payment to her roommates with the fear that she may start damaging the house intentionally.  She wants to enjoy my home until the last rent-free moment before she is evicted by the Sheriff.  Last month I sent her an email, offering that if she vacates on her own by the end of May, I will write off her two months unpaid rent. She replied ” I would rather want a full write off – clean slate to walk away”. She is an absolutely shameless creature.

I  sent a few emails to the Sheriff to schedule the eviction on the very first day the ban is lifted.  I have yet to hear from the Sheriff. They always give 10 days’ notice to the tenant for the eviction. My question, where is the 10 days’ notice law? The eviction ban is lifted from June 3, which means the Sheriff must be sitting in the office for 10 days on job ‘Rest’ until June 13. Is this not BS?   

So, my 16 months non-paying tenant has burned down $40K till now, and the intentional damages will not  be known until she is evicted. The hardest step against her will be her “eviction” without any repercussions. We SOLO landlords should develop a professional tenant’s database, under the control of SOLO management. The SOLO member LLs should contact the SOLO management to check that their rental applicant is not on the confidential list. 

LESSON LEARNED: The RTA is biased towards landlords, sanctions fraud and theft with no consequences. The system takes too long to protect law-abiding citizens who provide a service to Ontario residents. Landlords are selling their properties. Do not rent your property. It’s hazardous to your health and your finances.
