SOLO Landlord Story #13: Rental Arrears climbed from $3500 to $12000 due to delays

So D day came early for us today. The Sheriff’s appointment was for 11 AM and when we arrived at 10:15, he stood in an open door to the apartment and thanked us for being early. Tenant was leaving just as the Sheriff pulled up and she asked him to come in and look around. Asked him if he could inform us that she would pick up the bed frame later in the evening since it would not fit in her car and if we wanted her to clean the fridge or not? To have us message her.

Lo and behold the apartment was cleaned out, nothing broken or damaged….. we did not know what to expect…

It all started last year. Our Tenant was behind in rent, so March 19, 2020 we were halfway there to serve the tenant with papers, when our paralegal called us and told us that evictions had been halted by the Province. Well that then took till January 26, 2021 to get court in which the Judge should have given March 17th as the move out date by tenant. But the judge asked us what’s an extra 2 weeks, make it April 1. We obliged and waited for April 1st for our vacant apartment… nope tenant did not vacate. So we waited the slotted time and then applied for the Sheriff to evict our tenant. Well then came another stay at home order, so the sheriff called and apologized but he could not. So as soon as everything opened we got a call for the Sheriff to come today June 18, 2021. Are we happy that the unit is not damaged and destroyed, yes we are. But what gets us is the mentality of some tenants? Our lawyer offered her the option when we filed the application, to give us the unit back in 2 weeks and we would not seek payment from her to the tune of over $3,500. She replied, you can’t evict me! Then during court in January, the judge suggested we call her 1X time to see if we could come to terms. We offered her the same deal, give us the unit in 2 weeks and we will not come after lost rent, which now hovered around the $12,000 mark. She refused it and we then said to ourselves, gloves off, we will get our money. We have all the info we need from the Application and Lease forms……

Anyways, our story …. Could have been worse, but thanks to our government it was bad enough.
