Solo is pleased to announce that our advocacy efforts resulted in a Superior Court Order to move up a Sheriff writ of possession.
Congratulations to tenants Christine Matthews, Wayne Bradbury and Robyn Matthews who were successful in defrauding their landlord Juan Monterroza in Guelph, Ontario of $85,440.00. Attached is an 8 page public Order summarizing the history of their actions PUBLIC ORDER
Non-payment of rent took place in 2022 to March 15, 2025 and counting. Each tenant claimed bankruptcy and all of those documents are now PUBLIC information.
On April 15, 2025 the landlord was able to take his Order to the Sheriff’s Department and was told there would be a 15 week wait in Wellington County. However, he was at risk of losing his primary home to a creditor and a his rental property to another creditor (bank). Both creditors had submitted writs of possession in the Sheriff’s Department to re-possess the properties.
In an effort to achieve some form of expediency, Solo volunteers filed an application in Superior Court requesting the enforcement date to be moved up and it was granted. Solo would like to thank a certain individual who assisted in giving access to Justice. The eviction took place June 16, 2025 at 1:15 pm.
Solo tried to receive assistance from the Associate Attorney General’s office. One staff member replied that no assistance could be provided and after persisting, another email was sent to the Chief of Staff Blake Libfield and that email was not responded to. We need the Ministry of the Attorney General (MAG) to address the Sheriff shortages in certain Regions especially Wellington County and Peel Region. A 15 week wait (one week less than 4 months) is an unacceptable service marker particularly for those files that have taken so long to move through the Landlord Tenant Board.
Solo is helping housing providers fight back. In addition to educational content such as documentation and webinars, we’re leading an effort to help landlords understand how they can initiate criminal prosecutions for fraud, Freedom of Information requests and how to enforce payment through Small Claims Court. Now we know how to file Superior Court applications when you have been given a lengthy date for Sheriff enforcement and can refer you to a legal professional who you can hire to assist you. If you are a landlord in need of help, we welcome you to join us for free.
